OAKLAND, Calif., Feb. 15 /PRNewswire/ -- On February 14, temporary construction workers filed a class action lawsuit in Alameda Superior Court in Oakland, CA against Labor Ready Inc. (NYSE: LRW), one of the largest construction temporary help firms in the country, charging that the company's payroll practices violate California labor laws. If the court finds in favor of the workers, Labor Ready may be required to pay millions of dollars in back wages to workers throughout the state.

The issue at the heart of the class action suit concerns the definition of " hours worked." As a matter of company policy, Labor Ready temp workers must report to the company's dispatch offices between 5:00 and 6:00 a.m. to receive their daily assignment. Labor Ready, however, does not consider its workers to be "on the clock" until they physically reach the Labor Ready customer's worksite. Their laborers are considered "off the clock" as soon as the workers leave the client's property at the end of the day. But for most Labor Ready temp workers, the day is not over. They must return to the Labor Ready dispatch office at the end of each day to be paid.

The time spent waiting in the office for an assignment, and the time spent traveling to and from the work site may add up to several hours per day that are completely uncompensated.

Workers in California are required to be paid time and a half for working over eight hours in a day. Under California law, virtually all temporary employees who have worked for Labor Ready over the last four years could be eligible for back pay for uncompensated work time.

"I think there is strong evidence that Labor Ready's payroll practices violate California law," said David Rosenfeld, the plaintiffs' attorney. "Under California law, 'hours worked' certainly includes the time spent traveling to and from the Labor Ready office to the job sites of Labor Ready clients, as well as the time that Labor Ready requires employees to be present at its dispatch offices."

wow I drive 45 minutes to get to work each day. Man maybe I should file a law suit. Get off the gravy train. I hate people that want something for free. You are not required to sit at labor ready. Your free to leave anytime you want. Or better yet go get a job somewhere else. But maybe you can't because you just got out of prison, are still high from the crack you just smoked, or hung over from the night before. Oh yeah maybe you don't have a real job because you are not responsible enough to show up to work everyday on time. Finally you may just be straight up and down crazy and thats why you sit at Labor Ready for hours waiting to got to work.
Stop being irresponsible. Take control of your life. Don't point fingers or file law suits. You made your own problems along time ago. Your the one that dropped out of school. Your the one that got high or drunk. Everybody wants a handout and blame the next man when they need to blame themselves.

In response to the guy who seems to feel so strongly about his convictions. there are people who have completely legit reasons such as my friend. i will not state his name but he has stated his case to me and constantly proven it to be completely true. so if you feel that stronly about what you are saying why dont you take two steps back and think for a second. because going to labor ready does not neccissarily mean that you did any of the things you previously stated it just means that you need money and havent found a job suited to you or the one you have doesnt pay you enough. so as i stated above take two steps back and think about what your saying, if you do maybe you will stop being a moron.
